Article L1424-23-1 of the French General Code of Local Authorities

Transfers of personnel and assets that have not been carried out under the conditions and within the timeframes prescribed by the provisions of articles L. 1424-13 à L. 1424-19 shall be the subject of the agreements provided for therein no later than 31 December of the year following the promulgation of the law n° 2004-811 du 13 août 2004 de modernisation de la sécurité civile.

Failing this, the transfer is decided by decree in the Conseil d’Etat.

Article L1424-23-1

Les transferts des personnels et des biens qui n’ont pas été effectués dans les conditions et délais prescrits par les dispositions des articles L. 1424-13 à L. 1424-19 doivent faire l’objet des conventions prévues par celles-ci au plus tard le 31 décembre de l’année suivant la promulgation de la loi n° 2004-811 du 13 août 2004 de modernisation de la sécurité civile.

A défaut, le transfert est prononcé par décret en Conseil d’Etat.
