Article L1424-24-3 of the French General Code of Local Authorities

The representatives of the public establishments of inter-municipal cooperation are elected by the presidents of the public establishments of inter-municipal cooperation by proportional voting with the highest remainder among the members of their deliberative bodies and the members of the municipal councils of the member communes. Representatives of municipalities that are not members of these public bodies are elected by the mayors of these municipalities from among the members of their municipal councils by proportional representation with the highest remainder. Lists of candidates must be composed alternately of one candidate of each sex.

The number of votes available to each mayor, on the one hand, and each president of a public establishment for inter-municipal cooperation, on the other hand, within their respective electoral college is proportional to the population of the commune or communes making up the public establishment. It is set by order of the chairman of the fire and rescue service’s board of directors in the light of the decision taken to this effect by the board.

The representatives of the public establishments for inter-municipal cooperation and the communes are elected within four months of the general renewal of the municipal councils. The material organisation of this election is provided by the fire and rescue service.

Les représentants des établissements publics de coopération intercommunale sont élus par les présidents d’établissements publics de coopération intercommunale au scrutin proportionnel au plus fort reste parmi les membres de leurs organes délibérants et les membres des conseils municipaux des communes membres. Les représentants des communes qui ne sont pas membres de ces établissements publics sont élus par les maires de ces communes parmi les membres des conseils municipaux de celles-ci au scrutin proportionnel au plus fort reste. Les listes de candidats doivent être composées alternativement d’un candidat de chaque sexe.

Le nombre de suffrages dont dispose chaque maire, d’une part, chaque président d’établissement public de coopération intercommunale, d’autre part, au sein de leur collège électoral respectif est proportionnel à la population de la commune ou des communes composant l’établissement public. Il est fixé par arrêté du président du conseil d’administration du service d’incendie et de secours au vu de la délibération prise à cet effet par le conseil.

Les représentants des établissements publics de coopération intercommunale et des communes sont élus dans les quatre mois suivant le renouvellement général des conseils municipaux. L’organisation matérielle de cette élection est assurée par le service d’incendie et de secours.
