As from the notification of the higher bid, the purchaser, if he has regained possession of the business, is automatically the receiver and may only perform acts of administration. However, he may apply to the Commercial Court or the interim relief judge, as the case may be, at any time during the proceedings, for the appointment of another administrator. This request may also be made by any creditor. The higher bidder may not, even by paying the amount of the bid, prevent the public auction by withdrawing, except with the consent of all the registered creditors. The formalities of the procedure and of the sale shall be carried out at the instance of the overbidder and, in his absence, of any registered creditor or of the purchaser, at the expense, risk and peril of the overbidder and his surety remaining committed, in accordance with the rules prescribed by the articles L. 143-4, L. 143-5 to L. 143-7 and by the fourth paragraph of Article L. 143-10. In the absence of a bid, the highest bidder is declared the successful bidder.
