The Director General of the Regional Health Agency may appoint inspectors and controllers from among the Agency’s staff who meet the conditions of technical and legal aptitude defined by decree in the Conseil d’Etat, to carry out the duties provided for in this article in the same way as the staff mentioned in article L. 1421-1; he may also appoint experts to assist them. It may, under the same conditions, entrust them with the tasks provided for in article L. 313-13 of the Code de l’action sociale et des familles. The Agency’s inspectors and controllers have the prerogatives set out in articles L. 1421-2 and L. 1421-3 of this Code. The second and third paragraphs of article L. 1421-1 apply, where appropriate, to the qualified persons who assist them.
In order to monitor the collection of the quality and safety of care indicators mentioned in articles L. 6144-1 and L. 6161-2-2, the Director General of the Regional Health Agency may appoint the inspectors referred to in the first paragraph who are doctors or pharmacists, or use:
1° Medical officers or pharmacist advisors from the health insurance organisations, on the recommendation of the representatives of the health insurance schemes in the region;
2° Doctors who have signed a contract with the Regional Health Agency, who may be chosen in particular from among the experts of the Haute Autorité de santé referred to in article L. 1414-4.
The persons mentioned in 2° of this article must meet the technical and legal aptitude requirements defined by decree in the Conseil d’Etat.
The Director General of the Agency, on the report of an official mentioned in the first paragraph of this article or in article L. 1421-1, is required to inform the representative of the State with territorial jurisdiction and the Directors General of the Agence nationale de sécurité du médicament et des produits de santé, the Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail and the Agence de la biomédecine of any situation likely to lead to the implementation of administrative police measures falling within their remit.
The representative of the State in the département may, where necessary, call upon the services of the Regional Health Agency to carry out inspections.
