Article L145-29 of the French Commercial code

In the event of eviction, the premises must be returned to the lessor on expiry of a period of three months following the date of payment of the eviction compensation to the lessee himself or notification to the lessee of payment of the compensation to a receiver. In the absence of agreement between the parties, the receiver is appointed by the judgment ordering payment of the compensation or, failing this, by simple order on request.

The compensation is paid by the receiver to the tenant on his receipt alone, if there is no opposition from creditors and against surrender of the keys to the empty premises, on proof of payment of taxes, rents and subject to rental repairs.

En cas d’éviction, les lieux doivent être remis au bailleur à l’expiration d’un délai de trois mois suivant la date du versement de l’indemnité d’éviction au locataire lui-même ou de la notification à celui-ci du versement de l’indemnité à un séquestre. A défaut d’accord entre les parties, le séquestre est nommé par le jugement prononçant condamnation au paiement de l’indemnité ou à défaut par simple ordonnance sur requête.

L’indemnité est versée par le séquestre au locataire sur sa seule quittance, s’il n’y a pas d’opposition des créanciers et contre remise des clés du local vide, sur justification du paiement des impôts, des loyers et sous réserve des réparations locatives.
