Article L145-35 of the French Commercial code

Disputes arising from the application of articles L. 145-34 and L. 145-38 as well as those relating to service charges and works may be submitted to a departmental conciliation commission made up of landlords and tenants in equal numbers and qualified persons. The commission endeavours to reconcile the parties and issues an opinion.

If the matter is referred to the court in parallel with the competent commission by one or other of the parties, it cannot rule until the commission’s opinion has been issued.

The commission is relinquished if it has not given a ruling within three months.

The composition of the commission, the method of appointing its members and its operating rules are laid down by decree.

Les litiges nés de l’application des articles L. 145-34 et L. 145-38 ainsi que ceux relatifs aux charges et aux travaux peuvent être soumis à une commission départementale de conciliation composée de bailleurs et de locataires en nombre égal et de personnes qualifiées. La commission s’efforce de concilier les parties et rend un avis.

Si la juridiction est saisie parallèlement à la commission compétente par l’une ou l’autre des parties, elle ne peut statuer tant que l’avis de la commission n’est pas rendu.

La commission est dessaisie si elle n’a pas statué dans un délai de trois mois.

La composition de la commission, le mode de désignation de ses membres et ses règles de fonctionnement sont fixés par décret.
