Article L1453-8 of the French Public Health Code

The offer of a benefit covered by article L. 1453-7 is subject to the conclusion of an agreement between the beneficiary and the person referred to in article L. 1453-5. This agreement is subject to the declaration or authorisation procedures set out in subsections 2 and 3.

Where the agreement falls within the scope of Article L. 1121-16-1, the provisions of subsections 2 and 3 do not apply.

Article L1453-8

L’offre d’un avantage relevant de l’article L. 1453-7 est conditionnée à la conclusion d’une convention entre le bénéficiaire et la personne mentionnée à l’article L. 1453-5. Cette convention est soumise aux régimes de déclaration ou d’autorisation prévus aux sous-sections 2 et 3.

Lorsque la convention relève du champ de l’article L. 1121-16-1, les dispositions des sous-sections 2 et 3 ne sont pas applicables.
