I. – Prior authorisation from the Minister responsible for the economy is required for foreign investment in an activity in France which, even on an occasional basis, is involved in the exercise of public authority or falls within one of the following areas:
a) Activities likely to undermine public order, public security or the interests of national defence;
b) Activities relating to the research, production or marketing of weapons, munitions, powder and explosive substances.
A Conseil d’Etat decree defines the nature of the above activities and investments subject to authorisation.
II. – Any authorisation granted may be subject to conditions designed to ensure that the planned investment does not undermine the national interests referred to in I.
The decree referred to in I specifies the nature of the conditions that may be attached to the authorisation and how they may be revised.
