Article L152-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of this book in Saint-Barthélemy:
1° In article L. 141-2, the words: “or transfer to the State responsible for examining their asylum application” are deleted;
2° In Articles L. 142-1 to L. 142-4, references to Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and to the loi n° 78-17 du 6 janvier 1978 relative à l’informatique, aux fichiers et aux libertés are replaced by reference to the rules in force in mainland France under Regulation (EU) 2016/679 of 27 April 2016.

1° A l’article L. 141-2, les mots : ” ou de transfert vers l’Etat responsable de l’examen de sa demande d’asile ” sont supprimés ;
2° Aux articles L. 142-1 à L. 142-4, les références au règlement (UE) 2016/679 du 27 avril 2016 relatif à la protection à la protection des personnes physiques à l’égard des traitements des données à caractère personnel et à la libre circulation de ces données et à la loi n° 78-17 du 6 janvier 1978 relative à l’informatique, aux fichiers et aux libertés sont remplacées par la référence aux règles en vigueur en métropole en vertu du règlement (UE) 2016/679 du 27 avril 2016.
