Article L1526-3 of the French Public Health Code

For its application in Wallis and Futuna, article L. 1142-1 is replaced by the following provisions:

Art.L. 1142-1 -Where the sponsor is not liable, a medical accident, an iatrogenic condition or a nosocomial infection entitles the patient and, in the event of death, the patient’s heirs to compensation for damages under national solidarity schemes, where they are directly attributable to acts carried out in the context of research involving the human person and where they have had abnormal consequences for the patient with regard to his state of health or its foreseeable development.

Pour son application à Wallis-et-Futuna, l’article L. 1142-1 est remplacé par les dispositions suivantes :

Art.L. 1142-1.-Lorsque la responsabilité du promoteur n’est pas engagée, un accident médical, une affection iatrogène ou une infection nosocomiale ouvre droit à la réparation des préjudices du patient et, en cas de décès, de ses ayants droit au titre de la solidarité nationale, lorsqu’ils sont directement imputables à des actes effectués dans le cadre d’une recherche impliquant la personne humaine et qu’ils ont eu pour le patient des conséquences anormales au regard de son état de santé comme de l’évolution prévisible de celui-ci.
