Article L1526-9 of the French Public Health Code

For its application in Wallis and Futuna, article L. 1142-21 is replaced by the following provisions:

Art.L. 1142-21 -When the competent court, seised of a claim for compensation for the harmful consequences of research involving the human person, considers that the damage suffered is compensable under Article L. 1142-1 as it applies to Wallis and Futuna, the Office shall be summoned to the case if it was not initially summoned. It becomes a defendant in the proceedings.

Pour son application à Wallis-et-Futuna, l’article L. 1142-21 est remplacé par les dispositions suivantes :

Art.L. 1142-21.-Lorsque la juridiction compétente, saisie d’une demande d’indemnisation des conséquences dommageables d’une recherche impliquant la personne humaine estime que les dommages subis sont indemnisables au titre de l’article L. 1142-1 dans sa rédaction applicable à Wallis-et-Futuna, l’office est appelé en la cause s’il ne l’avait pas été initialement. Il devient défendeur en la procédure.
