Article L1542-10 of the French Public Health Code

For their application in New Caledonia and French Polynesia :

1° The first three paragraphs of Article L. 1243-2 are replaced by the following paragraph:

In order to be authorised to ensure the preparation, conservation, distribution and transfer, for autologous or allogeneic therapeutic purposes, of tissues and their derivatives and cell therapy preparations, health establishments must operate in accordance with the principles set out in Title I of this book.

2° In Article L. 1243-3 :

a) The words: “director of the regional health agency with territorial jurisdiction” are replaced by the words: “representative of the State in New Caledonia or French Polynesia”;

b) The following paragraph is added:

The State representative shall inform the competent health authority in New Caledonia and French Polynesia of the decisions taken in application of the preceding paragraphs.

3° In Article L. 1243-4 :

a) The words: “director of the regional health agency with territorial jurisdiction” are replaced by the words: “representative of the State in New Caledonia or French Polynesia”;

b) The following paragraph is added: :

The State representative shall inform the competent health authority in New Caledonia and French Polynesia of the authorisation granted.

4° Article L. 1243-6 is replaced by the following provisions:

Art.L. 1243-6 -To be authorised to perform tissue transplants and administer cell therapy preparations, health establishments must operate in accordance with the principles set out in Articles L. 1241-1 to L. 1241-7.

5° Article L. 1245-8 only applies to elements of the armed forces health service.

Article L1542-10

Pour leur application en Nouvelle-Calédonie et en Polynésie française :

1° Les trois premiers alinéas de l’article L. 1243-2 sont remplacés par l’alinéa suivant :

Pour être autorisés à assurer la préparation, la conservation, la distribution et la cession, à des fins thérapeutiques autologues ou allogéniques, des tissus et de leurs dérivés et des préparations de thérapie cellulaire, les établissements de santé doivent fonctionner en conformité avec les principes énoncés au titre Ier du présent livre.

2° A l’article L. 1243-3 :

a) Les mots : ” directeur de l’agence régionale de santé territorialement compétent ” sont remplacés par les mots : ” représentant de l’Etat en Nouvelle-Calédonie ou en Polynésie française ” ;

b) Il est ajouté un alinéa ainsi rédigé :

Le représentant de l’Etat informe l’autorité compétente en matière de santé de la Nouvelle-Calédonie et de la Polynésie française des décisions prises en application des alinéas précédents.

3° A l’article L. 1243-4 :

a) Les mots : ” directeur de l’agence régionale de santé territorialement compétent ” sont remplacés par les mots : ” représentant de l’Etat en Nouvelle-Calédonie ou en Polynésie française “;

b) Il est ajouté un alinéa ainsi rédigé :

Le représentant de l’Etat informe l’autorité compétente en matière de santé de la Nouvelle-Calédonie et de la Polynésie française de l’autorisation délivrée.

4° L’article L. 1243-6 est remplacé par les dispositions suivantes :

Art.L. 1243-6.-Pour être autorisés à pratiquer des greffes de tissus et à administrer des préparations de thérapie cellulaire, les établissements de santé doivent fonctionner en conformité avec les principes énoncés aux articles L. 1241-1 à L. 1241-7.

5° L’article L. 1245-8 est applicable uniquement aux éléments du service de santé des armées.
