Article L1542-12 of the French Public Health Code

For their application in New Caledonia and French Polynesia :

a) In Article L. 1245-1, the last two paragraphs do not apply ;

b) Article L. 1245-5 is replaced by the following provisions:

Art.L. 1245-5.- Only persons whose activity involves medical biology examinations, anatomical cytopathology examinations, legal expertise or quality control or assessment, in particular of in vitro diagnostic medical devices, may import or export biological samples.

Only organisations authorised by the Minister for Research may import or export tissues and cells for scientific purposes.

The Agence de la biomédecine is informed of authorisations issued pursuant to this article.

Pour leur application en Nouvelle-Calédonie et en Polynésie française :

a) A l’article L. 1245-1, les deux derniers alinéas ne sont pas applicables ;

b) L’article L. 1245-5 est remplacé par les dispositions suivantes :

Art.L. 1245-5.-Seules peuvent importer ou exporter des échantillons biologiques les personnes dont l’activité comporte des examens de biologie médicale, des examens d’anatomo-cytopathologie, des expertises judiciaires ou des contrôles de qualité ou d’évaluation, notamment de dispositifs médicaux de diagnostic in vitro.

Seuls peuvent importer ou exporter des tissus et cellules à des fins scientifiques les organismes autorisés par le ministre chargé de la recherche.

L’Agence de la biomédecine est informée des autorisations délivrées en application du présent article.
