For their application in New Caledonia and French Polynesia:
1° In Article L. 1231-1, V does not apply ;
2° In the first paragraph of Article L. 1231-3, the words “Minister of Health” are replaced by the words “Representative of the State in New Caledonia or French Polynesia, taken after consultation with the health authorities of New Caledonia and French Polynesia”;
3° Article L. 1231-4 reads as follows:
Art. L. 1231-4 -The procedures for applying this chapter as it applies in New Caledonia and French Polynesia are determined by decree in the Conseil d’Etat, in particular the provisions applicable to cross-donation of organs;
4° In the second paragraph of Article L. 1232-1, the words: “in accordance with good practice established by the Minister for Health on a proposal from the Biomedicine Agency” are deleted.
5° Article L. 1233-1 is replaced by the following provisions:
Art. L. 1233-1 -To be authorised to carry out organ removal with a view to donation for therapeutic purposes, health establishments must operate in accordance with the principles set out in Articles L. 1211-1 et seq.
6° Article L. 1234-2 is replaced by the following provisions:
Art. L. 1234-2 -To be authorised to carry out organ transplants, health establishments must operate in accordance with the principles set out in articles L. 1211-1 et seq. and in this Title.
