For their application in New Caledonia and French Polynesia:
1° In Article L. 1241-1, the words: “by the Agence nationale de sécurité du médicament et des produits de santé pursuant to 1° of Article L. 5311-2” are replaced by the words: “in accordance with the conditions laid down by local regulations having the same purpose” ;
2° In the last paragraph of Article L. 1241-3, the words: “in particular with regard to the rules of good practice mentioned in Article L. 1245-6,” are deleted;
3° Article L. 1242-1 is replaced by the following provisions:
Art. L. 1242-1 -To be authorised to collect human tissues and cells for donation for therapeutic purposes, health establishments must operate in accordance with the principles set out in Articles L. 1211-1 et seq. and in this Title.
4° For the application in New Caledonia of article L. 1241-4 in New Caledonia:
a) The first paragraph is replaced by the first to third paragraphs of the same article, as amended by Act No. 2011-814 of 7 July 2011;
b) The second paragraph, now the fourth paragraph, is replaced by the fourth paragraph of the same article, as amended by the same Act, subject to the insertion, after the word “bone”, of the words: “or peripheral blood” and, after the word “benefit”, of the words: “
c) The third paragraph becomes the fifth paragraph;
d) In the fourth paragraph, which becomes the sixth paragraph, the words: “of the first three paragraphs” are replaced by the words: “of the fifth paragraph”;
e) In the fifth paragraph, which becomes the seventh paragraph, the words: “its opinion” are replaced by the words: “the opinion mentioned in the fourth paragraph” and the words: “provided for in the fourth paragraph” are replaced by the words: “provided for in the sixth paragraph”.
