Article L1544-6 of the French Public Health Code

For the application in New Caledonia and French Polynesia of article L. 1142-14, the first paragraph is replaced by the following provisions:

Where the Commission considers that the sponsor is liable for damage covered by article L. 1142-3, as applicable in New Caledonia and French Polynesia, the insurer of the sponsor of research involving the human person shall, within four months of the date of receipt of the opinion, make an offer of compensation to the victim or those entitled on his behalf, seeking full reparation for the damage suffered.

Pour l’application en Nouvelle-Calédonie et en Polynésie française de l’article L. 1142-14, le premier alinéa est remplacé par les dispositions suivantes :

Lorsque la commission estime qu’un dommage relevant de l’article L. 1142-3, dans sa rédaction applicable en Nouvelle-Calédonie et en Polynésie française, engage la responsabilité du promoteur, l’assureur du promoteur de la recherche impliquant la personne humaine adresse à la victime ou à ses ayants droit, dans un délai de quatre mois suivant la date de réception de l’avis, une offre d’indemnisation visant à la réparation intégrale des préjudices subis.
