Article L163-10 of the French Monetary and Financial Code

A fine of 12,000 euros shall be imposed on the drawee who:

1. Indicate a provision that is less than the existing and available provision;

2. Rejecting a cheque on the grounds of insufficient or unavailable funds without indicating, where this is the case, that the cheque has been issued in defiance of an injunction issued pursuant to article L. 131-73 or in breach of a prohibition issued pursuant to article L. 163-6 ;

3. Failure to report payment incidents and offences under the third paragraph of article L. 163-2 and the first and second paragraphs of article L. 163-7 , in accordance with the conditions laid down by decree in the Conseil d’Etat;

4. Contravene the provisions of articles L. 131-72, L. 131-73 and the third paragraph of article L. 163-6.

Article L163-10

Est puni d’une amende de 12 000 euros le fait, pour le tiré :

1. D’indiquer une provision inférieure à la provision existante et disponible ;

2. De rejeter un chèque pour insuffisance ou indisponibilité de la provision sans indiquer, lorsque tel est le cas, que le chèque a été émis au mépris d’une injonction adressée en application de l’article L. 131-73 ou en violation d’une interdiction prononcée en application de l’article L. 163-6 ;

3. De ne pas déclarer, dans les conditions prévues par décret en Conseil d’Etat, les incidents de paiement ainsi que les infractions prévues par le troisième alinéa de l’article L. 163-2 et les premier et deuxième alinéas de l’article L. 163-7 ;

4. De contrevenir aux dispositions des articles L. 131-72, L. 131-73 et au troisième alinéa de l’article L. 163-6.
