In all the cases provided for in articles L. 163-2 to L. 163-4-1 and L. 163-7, the court may order the disqualification from civic, civil and family rights provided for in article 131-26 of the Criminal Code and the disqualification, for a maximum of five years, from exercising a professional or social activity, pursuant to the provisions of articles 131-27 and 131-28 of the Criminal Code.
In the same cases, the court may prohibit the convicted person, for a period of five years, from issuing cheques other than those that allow only the drawer to withdraw funds from the drawee or those that are certified. This ban may be declared enforceable by provision. It is accompanied by an injunction to the convicted person to return to the bankers who issued the forms in his possession or that of his agents. The court may order, at the convicted person’s expense, the publication of extracts of the decision to ban in the newspapers it designates and in the manner it determines.
As a result of the ban, any banker informed of the ban by the Banque de France must refrain from issuing to the convicted person and his agents cheque forms other than those mentioned in the previous paragraph.
