Article L163-7 of the French Monetary and Financial Code

It is an offence for any person to issue one or more cheques in breach of the prohibition imposed under article L. 163-6, and is punishable by five years’ imprisonment and a fine of 375,000 euros.

The same penalties shall apply if an agent knowingly issues one or more cheques that the principal was prohibited from issuing pursuant to article L. 163-6.

For the purposes of investigating, prosecuting, investigating and judging the offences referred to in the preceding paragraphs, the court of the place where the cheque is payable shall have jurisdiction, without prejudice to the application of articles 43, 52 and 382 of the Code of Criminal Procedure.

Article L163-7

Est puni d’un emprisonnement de cinq ans et d’une amende de 375 000 euros le fait, pour toute personne, d’émettre un ou plusieurs chèques en violation de l’interdiction prononcée en application de l’article L. 163-6.

Est puni des mêmes peines le fait, pour un mandataire, d’émettre, en connaissance de cause, un ou plusieurs chèques dont l’émission était interdite à son mandant en application de l’article L. 163-6.

Pour la recherche, la poursuite, l’instruction et le jugement des infractions mentionnées aux alinéas précédents, le tribunal du lieu où le chèque est payable est compétent, sans préjudice de l’application des articles 43,52 et 382 du code de procédure pénale.
