The ownership of private roads open to public traffic in housing estates may, after a public enquiry opened by the mayor or the president of the public establishment for inter-communal cooperation and carried out in accordance with locally applicable regulations, be automatically transferred without compensation into the public domain of the commune in whose territory the roads are located.
The decision by the administrative authority to transfer the property is equivalent to its classification in the public domain and extinguishes, by itself and on its date, all real and personal rights existing over the property transferred.
This decision is taken by deliberation of the municipal council.
This decision is taken by deliberation of the municipal council or the deliberative body of the public establishment for inter-communal cooperation. If an interested owner has made his opposition known, this decision is taken by order of the High Commissioner, at the request of the commune.
