Article L2113-8 of the French General Code of Local Authorities

During the first renewal following the creation of the new commune, the municipal council comprises a number of members equal to the number provided for in Article L. 2121-2 for a commune belonging to the next highest demographic stratum. This number may not be less than one third of the sum of the municipal councillors elected at the previous general renewal of the municipal councils, in accordance with article L. 2121-2, in each commune grouped together prior to the creation of the new commune, rounded up to the next whole number and increased by one in the case of an even number of councillors. It may also not be greater than sixty-nine.

The size of the municipal council remains identical until the second general renewal of the municipal councils following the creation of the new commune.

The cumulative amount of the allowances of the members of the municipal council of the new commune may not exceed the cumulative amount of the maximum allowances to which the members of the municipal council of a commune belonging to the same demographic stratum would be entitled.

Lors du premier renouvellement suivant la création de la commune nouvelle, le conseil municipal comporte un nombre de membres égal au nombre prévu à l’article L. 2121-2 pour une commune appartenant à la strate démographique immédiatement supérieure. Ce nombre ne peut être inférieur au tiers de l’addition des conseillers municipaux élus lors du précédent renouvellement général des conseils municipaux, conformément à l’article L. 2121-2, dans chaque commune regroupée avant la création de la commune nouvelle, arrondi à l’entier supérieur et augmenté d’une unité en cas d’effectif pair. Il ne peut également être supérieur à soixante-neuf.

L’effectif du conseil municipal reste identique jusqu’au deuxième renouvellement général des conseils municipaux suivant la création de la commune nouvelle.

Le montant cumulé des indemnités des membres du conseil municipal de la commune nouvelle ne peut excéder le montant cumulé des indemnités maximales auxquelles auraient droit les membres du conseil municipal d’une commune appartenant à la même strate démographique.
