Article L2121-30-1 of the French General Code of Local Authorities

For the application of article 75 of the Civil Code, the mayor may, unless the public prosecutor objects, allocate any communal building, other than that of the community centre, located within the commune, to the celebration of marriages.

The public prosecutor ensures that the mayor’s decision guarantees the conditions for a solemn, public and republican celebration. He also ensures that the conditions relating to the proper maintenance of civil status are met.

The conditions for informing and objecting to the public prosecutor are laid down by decree.

Pour l’application de l’article 75 du code civil, le maire peut, sauf opposition du procureur de la République, affecter à la célébration de mariages tout bâtiment communal, autre que celui de la maison commune, situé sur le territoire de la commune.


Le procureur de la République veille à ce que la décision du maire garantisse les conditions d’une célébration solennelle, publique et républicaine. Il s’assure également que les conditions relatives à la bonne tenue de l’état civil sont satisfaites.


Les conditions d’information et d’opposition du procureur de la République sont fixées par décret.
