Article L2121-36 of the French General Code of Local Authorities

The special delegation is appointed by decision of the representative of the State in the département within eight days of the dissolution, the definitive annulment of the elections, the acceptance of the resignation or the declaration that it is impossible to form the municipal council.

The special delegation elects its chairman and, if applicable, its vice-chairman.

The chairman, or, failing that, the vice-chairman, performs the duties of mayor. His powers end as soon as the new council is installed.

La délégation spéciale est nommée par décision du représentant de l’Etat dans le département dans un délai de huit jours à compter de la dissolution, de l’annulation définitive des élections, de l’acceptation de la démission ou de la constatation de l’impossibilité de constituer le conseil municipal.

La délégation spéciale élit son président et, s’il y a lieu, son vice-président.

Le président, ou, à défaut, le vice-président, remplit les fonctions de maire. Ses pouvoirs prennent fin dès l’installation du nouveau conseil.
