Article L2122-10-7 of the French Labour Code

Voting takes place electronically and by post. Where it does not, the employer is not obliged to provide employees with computer equipment enabling electronic voting.

The conditions governing the conduct of the ballot and the confidentiality of the vote are determined by decree of the Conseil d’Etat. The aforementioned decree also specifies the information to be provided to employees.

Le scrutin a lieu par voie électronique et par correspondance. Lorsqu’il n’en dispose pas, l’employeur n’a pas l’obligation de mettre à la disposition des salariés le matériel informatique permettant le vote par voie électronique.


Les conditions de déroulement du scrutin et de confidentialité du vote sont déterminées par décret en Conseil d’Etat. Ledit décret précise également les modalités de l’information délivrée aux salariés.
