Article L2122-6-1 of the French Labour Code

For the staff mentioned inarticle L. 123-2 of the Social Security Code and, in Mayotte, inarticle 25-1 of order no. 96-1122 of 20 December 1996 relating to the improvement of public health, to sickness, maternity, invalidity and death insurance, to the financing of social security in Mayotte and to the Social Security Fund in Mayotte, who do not have representation arrangements applicable to their specific circumstances, the threshold set in 3° of article L. 2122-5 of this code is assessed with regard to the votes cast during the election of the members representing the employees on the national joint committees set up by their specific national collective agreement.

A decree in the Conseil d’Etat defines the terms and conditions for the application of this article.

Article L2122-6-1

Pour les personnels mentionnés à l’article L. 123-2 du code de la sécurité sociale et, à Mayotte, à l’article 25-1 de l’ordonnance n° 96-1122 du 20 décembre 1996 relative à l’amélioration de la santé publique, à l’assurance maladie, maternité, invalidité et décès, au financement de la sécurité sociale à Mayotte et à la Caisse de sécurité sociale à Mayotte qui ne disposent pas de modalités de représentation applicables à leurs spécificités, le seuil fixé au 3° de l’article L. 2122-5 du présent code est apprécié au regard des suffrages exprimés lors de l’élection des membres représentant les salariés aux commissions paritaires nationales instituées par leur convention collective nationale spécifique.

Un décret en Conseil d’Etat définit les modalités d’application du présent article.
