Article L2131-5 of the French General Code of Local Authorities

The provisions of articles L. 2131-1 to L. 2131-4 do not prevent the representative of the State in the department from exercising the power of substitution that he or she holds, particularly in police matters, under Articles L. 2215-1 and L. 2215-5, nor to that of his hierarchical power over the acts of the mayor when the latter, pursuant to Articles L. 2122-27 et L. 2122-34, acts as an agent of the State in the commune.

Les dispositions des articles L. 2131-1 à L. 2131-4 ne font pas obstacle à l’exercice, par le représentant de l’Etat dans le département, du pouvoir de substitution qu’il tient, notamment en matière de police, des articles L. 2215-1 et L. 2215-5, ni à celui de son pouvoir hiérarchique sur les actes du maire lorsque celui-ci, en application des articles L. 2122-27 et L. 2122-34, agit comme agent de l’Etat dans la commune.
