Article L214-101 of the French Monetary and Financial Code

The management company may, on behalf of the non-trading property investment company (société civile de placement immobilier) or forestry savings company (société d’épargne forestière) that it manages, take out loans, assume debts or make acquisitions payable in advance, up to a maximum limit set by the General Meeting.

This limit takes into account the indebtedness of the companies mentioned in 2° of I of Article L. 214-115.

With regard to third parties, the company may not rely on the limitations or restrictions on its powers resulting from this article.

Article L214-101

La société de gestion peut, au nom de la société civile de placement immobilier ou de la société d’épargne forestière qu’elle gère, contracter des emprunts, assumer des dettes ou procéder à des acquisitions payables à terme, dans la limite d’un maximum fixé par l’assemblée générale.

Cette limite tient compte de l’endettement des sociétés mentionnées au 2° du I de l’article L. 214-115.

A l’égard des tiers, la société ne peut se prévaloir des limitations ou restrictions de pouvoirs résultant du présent article.
