Article L214-24-43 of the French Monetary and Financial Code

The management company is required to make the declarations stipulated in articles L. 225-126 and L. 233-7 of the French Commercial Code, for all shares held by the mutual funds it manages.

Articles L. 225-126, II and III and articles L. 233-14 and L. 247-2 of the French Commercial Code are applicable.

When the management company complies with the notification obligation mentioned in article L. 214-24-22, it is not bound by the information obligation mentioned in II of article L. 233-7 of the Commercial Code for the same thresholds.

La société de gestion est tenue d’effectuer les déclarations prévues aux articles L. 225-126 et L. 233-7 du code de commerce, pour l’ensemble des actions détenues par les fonds communs de placement qu’elle gère.

Les II et III de l’article L. 225-126 et les articles L. 233-14 et L. 247-2 du code de commerce sont applicables.

Lorsque la société de gestion satisfait à l’obligation de notification de franchissement de seuils mentionnée à l’article L. 214-24-22, elle n’est pas tenue à l’obligation d’information mentionnée au II de l’article L. 233-7 du code de commerce pour les mêmes seuils.
