Article L214-24-53 of the French Monetary and Financial Code

When the AMF becomes aware of an infringement of the provisions of this Code committed by a statutory auditor of a management company or a general-purpose investment fund, or when it considers that the conditions of independence required for the proper performance of the statutory auditor’s duties are not met, the AMF may ask the competent court to relieve the statutory auditor of his duties in accordance with the procedures set out in Article L. 823-7 of the Commercial Code.

The Autorité des marchés financiers may also report the infringement to the competent disciplinary authority and, to this end, provide it with all the information necessary for it to be properly informed.

Article L214-24-53

Lorsqu’elle a connaissance d’une infraction aux dispositions du présent code commise par un commissaire aux comptes d’une société de gestion ou d’un fonds d’investissement à vocation générale ou lorsqu’elle considère que les conditions d’indépendance nécessaires au bon déroulement de la mission de ce commissaire aux comptes ne sont pas remplies, l’Autorité des marchés financiers peut demander au tribunal compétent de relever celui-ci de ses fonctions selon les modalités mentionnées à l’article L. 823-7 du code de commerce.

L’Autorité des marchés financiers peut également dénoncer l’infraction à l’autorité disciplinaire compétente et lui communiquer à cette fin tous les renseignements nécessaires à sa bonne information.
