Article L2141-10 of the French Labour Code

The provisions of this Title shall not prevent collective labour agreements or arrangements containing more favourable clauses, in particular those relating to the establishment of trade union delegates or central trade union delegates in all cases where the legal provisions have not made such establishment compulsory.

No limitation may be placed on the provisions relating to the exercise of trade union rights by memorandum or unilateral decision of the employer.

Les dispositions du présent titre ne font pas obstacle aux conventions ou accords collectifs de travail comportant des clauses plus favorables, notamment celles qui sont relatives à l’institution de délégués syndicaux ou de délégués syndicaux centraux dans tous les cas où les dispositions légales n’ont pas rendu obligatoire cette institution.

Aucune limitation ne peut être apportée aux dispositions relatives à l’exercice du droit syndical par note de service ou décision unilatérale de l’employeur.
