Each trade union which, in accordance with Article L. 2142-1, constitutes a trade union section within the undertaking or establishment of at least fifty employees may, if it is not representative in the undertaking or establishment, appoint a section representative to represent it within the undertaking or establishment.
The representative of the trade union section carries out his duties within the framework of the provisions of this chapter. He shall enjoy the same prerogatives as the trade union delegate, with the exception of the power to negotiate collective agreements.
The mandate of the trade union section representative ends, at the end of the first professional elections following his designation, if the trade union which designated him is not recognised as representative in the company. An employee who loses his trade union representative mandate in this way may not be reappointed as a trade union representative for a section until six months before the date of the next professional elections in the company.
