Each trade union section representative has the time required to carry out his/her duties. This time is at least equal to four hours per month. Delegation time is automatically considered as working time and is paid at the normal rate.
If the employer wishes to contest the use made of delegation hours, it shall refer the matter to the court.
Unless there is a collective agreement to the contrary, when the elected or appointed staff representative is an employee referred to in article L. 3121-58, the time credit is grouped into half-days which are deducted from the annual number of days worked set in the employee’s individual agreement. A half-day corresponds to four hours of office. When the remaining credit or fraction of the credit is less than four hours, the staff representative benefits from it under conditions defined by a decree of the Conseil d’Etat.
