The following professional employers’ organisations are representative at national and inter-professional level:
1° Which meet the criteria mentioned in 1° to 5° of article L. 2151-1;
2° Whose member organisations are representative in the branches of industry, construction, commerce and services;
3° Whose member companies and organisations are up to date with their membership fees and represent either at least 8% of all companies belonging to professional employers’ organisations meeting the criteria mentioned in 1° to 4° of article L. 2151-1 and having made the declaration of candidacy provided for in article L. 2152-5, or at least 8% of the employees of these same companies. The number of companies belonging to these organisations, as well as the number of their employees, are certified, for each of them, by an auditor, who may be that of the organisation, under conditions determined by regulation. The audience is measured every four years.
Where a professional employers’ organisation is a member of several professional employers’ organisations with a statutory vocation to be present at national and cross-industry level, it shall divide its member companies between these organisations to enable the audience measurement provided for in this article. It may not allocate to each of these organisations a share of companies lower than a percentage set by decree, of between 10% and 20%. The distribution key used applies to the number of employees in these companies. The professional employers’ organisation shall indicate the distribution adopted in the declaration of candidacy provided for in article L. 2152-5. Member companies are informed of this distribution.
