Article L2194-1 of the French Public procurement code

A contract may be amended without a new competitive tendering procedure under the conditions laid down by regulation, when:
1° The amendments were provided for in the initial contractual documents;
2° Additional works, supplies or services have become necessary;
3° The amendments are made necessary by unforeseen circumstances;
4° A new contractor replaces the initial contractor;
5° The amendments are not substantial;
6° The amendments are small in amount.
Whether they are made by agreement or, in the case of an administrative contract, by the purchaser unilaterally, such amendments may not change the overall nature of the contract.

Un marché peut être modifié sans nouvelle procédure de mise en concurrence dans les conditions prévues par voie réglementaire, lorsque :
1° Les modifications ont été prévues dans les documents contractuels initiaux ;
2° Des travaux, fournitures ou services supplémentaires sont devenus nécessaires ;
3° Les modifications sont rendues nécessaires par des circonstances imprévues ;
4° Un nouveau titulaire se substitue au titulaire initial du marché ;
5° Les modifications ne sont pas substantielles ;
6° Les modifications sont de faible montant.
Qu’elles soient apportées par voie conventionnelle ou, lorsqu’il s’agit d’un contrat administratif, par l’acheteur unilatéralement, de telles modifications ne peuvent changer la nature globale du marché.
