Article L2213-10 of the French Public procurement code

Where the partnership contract involves the occupation of the public domain, it constitutes an authorisation to occupy this domain for its duration. Unless otherwise stipulated in the contract, the contractor has rights in rem over the works and equipment it builds. These rights confer on it the prerogatives and obligations of the owner, under the conditions and within the limits defined by the clauses of the contract designed to guarantee the integrity and use of the public domain.

Lorsque le marché de partenariat emporte occupation du domaine public, il vaut autorisation d’occupation de ce domaine pour sa durée. Le titulaire a, sauf stipulation contraire de ce contrat, des droits réels sur les ouvrages et équipements qu’il réalise. Ces droits lui confèrent les prérogatives et obligations du propriétaire, dans les conditions et les limites définies par les clauses du contrat ayant pour objet de garantir l’intégrité et l’affectation du domaine public.
