Article L2213-30 of the French General Code of Local Authorities

The mayor must order the necessary measures to ensure the sanitation of communal ponds located in the interior of villages or in the vicinity of dwellings, whenever these ponds compromise public health.

Failing the mayor, the representative of the State in the department may, on the advice of the hygiene council and after a commodo et incommodo investigation carried out under the conditions provided for by the environment code, prescribe at the expense of the commune the work recognised as useful.

Le maire doit ordonner les mesures nécessaires pour assurer l’assainissement des mares communales placées dans l’intérieur des villages ou dans le voisinage des habitations, dès lors que ces mares compromettent la salubrité publique.

A défaut du maire, le représentant de l’Etat dans le département peut, sur l’avis du conseil d’hygiène et après enquête de commodo et incommodo réalisée dans les conditions prévues par le code de l’environnement, prescrire aux frais de la commune les travaux reconnus utiles.
