Article L2213-31 of the French General Code of Local Authorities

The mayor shall order the owners of ponds or ditches with stagnant water established in the vicinity of dwellings to carry out the work or take the necessary measures to put an end to all causes of insalubrity.

In the event of refusal or negligence, the mayor shall report the state of insalubrity found to the representative of the State in the department.

The representative of the State in the department, after obtaining the opinion of the hygiene council and the hydraulic service, may prescribe that the work recognised as necessary be carried out automatically at the owner’s expense, after prior formal notice.

Le maire prescrit aux propriétaires de mares ou de fossés à eau stagnante établis dans le voisinage des habitations d’exécuter les travaux ou de prendre les mesures nécessaires pour faire cesser toutes causes d’insalubrité.

En cas de refus ou de négligence, le maire dénonce au représentant de l’Etat dans le département l’état d’insalubrité constatée.

Le représentant de l’Etat dans le département, après avis du conseil d’hygiène et du service hydraulique, peut prescrire que les travaux reconnus nécessaires seront exécutés d’office aux frais du propriétaire, après mise en demeure préalable.
