Article L2221-5-1 of the French General Code of Local Authorities

The provisions of Article L. 1618-2 are applicable to the régies mentioned in Article L. 2221-1 subject to the following provisions:

a) They may waive the obligation to deposit with the State funds that come from cash surpluses resulting from their business cycle;

b) The régies responsible for managing a public service of an industrial and commercial nature mentioned in Article L. 2221-10 may deposit their funds, after express authorisation from the competent State authority, in an account opened with La Poste or with a credit institution that has obtained authorisation under the provisions applicable in the Member States of the European Community or the other States party to the Agreement on the European Economic Area;

c) For the régies mentioned in b, the Board of Directors may delegate to the Director the decisions mentioned in III of Article L. 1618-2.

Article L2221-5-1

Les dispositions de l’article L. 1618-2 sont applicables aux régies mentionnées à l’article L. 2221-1 sous réserve des dispositions suivantes :

a) Elles peuvent déroger à l’obligation de dépôt auprès de l’Etat pour les fonds qui proviennent des excédents de trésorerie résultant de leur cycle d’activité ;

b) Les régies chargées de la gestion d’un service public à caractère industriel et commercial mentionnées à l’article L. 2221-10 peuvent déposer leurs fonds, après autorisation expresse l’autorité compétente de l’Etat, sur un compte ouvert à La Poste ou dans un établissement de crédit ayant obtenu un agrément en vertu des dispositions applicables dans les Etats membres de la Communauté européenne ou les autres Etats parties à l’accord sur l’Espace économique européen ;

c) Pour les régies mentionnées au b, le conseil d’administration peut déléguer au directeur les décisions mentionnées au III de l’article L. 1618-2.
