Communities and public establishments for inter-communal cooperation have sole authority to create and manage crematoria and cinerary sites. Crematoria and adjoining cinerary sites may be managed directly or by delegated management. Cinerary sites included within the perimeter of a cemetery or not contiguous to a crematorium must be managed directly.
When a cinerary site contiguous to a crematorium is the subject of a public service delegation, the land on which it is located and the equipment it comprises are subject to a clause for return to the municipality or the public establishment for inter-municipal cooperation at the end of the delegation.
Any creation or extension of a crematorium may not take place without the authorisation of the State representative in the department, granted after a public enquiry carried out in accordance with Chapter III of Title II of Book I of the Environmental Code and an opinion from the departmental commission competent in environmental, health and technological risk matters.
