Article L2223-42-1 of the French General Code of Local Authorities

At the request of the person entitled to provide for the funeral and when the body of the deceased has been placed, in order to ensure its transport, in a coffin made of a material presenting an obstacle to cremation, an authorisation to transfer the body to a suitable coffin may be issued by the mayor.

This authorisation may only be issued with a view to cremation of the body, which takes place immediately after the coffin has been changed, and on condition that the deceased has not been affected by one of the transmissible infections that prescribe or prohibit certain funeral operations, the list of which is laid down by regulation.

A decree of the Council of State specifies the conditions for the transfer of the body to a suitable coffin.

A la demande de la personne ayant qualité pour pourvoir aux funérailles et lorsque le corps du défunt a été placé, pour assurer son transport, dans un cercueil composé d’un matériau présentant un obstacle à la crémation, une autorisation de transfert du corps vers un cercueil adapté peut être délivrée par le maire.


Cette autorisation ne peut être délivrée qu’en vue de la crémation du corps, qui s’opère sans délai après le changement de cercueil, et à condition que le défunt n’ait pas été atteint par l’une des infections transmissibles prescrivant ou interdisant certaines opérations funéraires, dont la liste est fixée par voie réglementaire.


Un décret en Conseil d’Etat précise les conditions d’application du présent article.
