Nationals of a Member State of the European Community or of another State party to the Agreement on the European Economic Area wishing to establish themselves in France to carry out all or some of the professional activities mentioned in articles L. 2223-23 et L. 2223-41 must demonstrate:
1° Professional experience, as a manager within the meaning of Article 3. 1. i of Directive 2005/36/EC of the European Parliament and of the Council of 7 September 2005 on the recognition of professional qualifications or in a self-employed capacity for the activity in question:
– of three consecutive years;
– or of two consecutive years if the applicant provides evidence of prior training attested by a certificate recognised by the State in which he practised, or judged to be fully valid by a competent professional body in that State;
– or two consecutive years if the applicant can prove that he has worked as an employee for three years;
2° Or three consecutive years’ professional experience as an employee in one of the functions mentioned in articles L. 2223-19 and L. 2223-41 and the measures taken for their application in respect of which he wishes to establish himself, if the applicant provides evidence of prior training attested by a certificate recognised by the State in which he practised, or deemed fully valid by a competent professional body in that same State.
In all the cases mentioned in this article, the professional experience must have been acquired in a Member State of the European Community or another State party to the Agreement on the European Economic Area during the ten years preceding the application for recognition of professional qualifications.
Access to only part of the professional activities is carried out under the conditions laid down by order of the Minister of the Interior.
