The public service delegation contract for water or sanitation requires the delegatee, firstly, to draw up a detailed inventory of the delegator’s assets at the end of the contract and, secondly, without prejudice to any other penalties provided for in the contract, to pay into the delegator’s drinking water or sanitation budget a sum corresponding to the amount of the works stipulated in the provisional programme mentioned in article L. 2224-11-3 and not performed.
The subscriber file, consisting of personal data for billing water and wastewater services, as well as the characteristics of the meters and the updated network plans, are submitted by the delegatee to the delegating authority at least six months before the expiry of the contract or, for contracts expiring within six months of the date of promulgation of Law no. 2010-788 of 12 July 2010 on the national commitment to the environment, on the expiry date of the contract and no later than six months from this date of promulgation. A decree in the Conseil d’Etat, issued after consultation with the Commission nationale de l’informatique et des libertés, defines the terms and conditions for the application of this paragraph, in particular setting the terms and conditions for the transmission of personal data to the delegating authority, the processing and storage of this data by the delegating authority, and the transmission of this data to the department responsible for invoicing.
