Municipalities and groups of local authorities, after consulting the consultative commission for local public services, draw up, for each water or sanitation service for which they are responsible, service regulations defining, according to local conditions, the services provided by the service and the respective obligations of the operator, subscribers, users and owners.
The operator gives each subscriber the service regulations or sends them to him by post or electronic mail. The payment of the first bill following the distribution of the service regulations or their update shall constitute acknowledgement of receipt by the subscriber. The service regulations are made available to users.
The operator reports to the mayor or the president of the group of local authorities on the procedures and effectiveness of the distribution of the service regulations.
In the event that the subscriber uses another water resource, the service regulations provide for the possibility of drinking water service agents gaining access to private property in order to carry out inspections of internal drinking water distribution installations and of abstraction works, wells and boreholes. The cost of the inspection is borne by the customer. If there is a risk of contamination of water from the public distribution network by water from another source, the service will require the customer to implement the necessary protective measures. If these measures are not implemented, the service may close the water connection. A decree in the Conseil d’Etat shall set out the procedures for access to private property and inspection of the installations provided for in this article.
Users of drinking water services may submit a request to terminate their subscription contract at any time. This contract is terminated under the conditions set out in the regulations for each service, within a period that may not exceed fifteen days from the date of presentation of the request.
