Article L2226-1 of the French General Code of Local Authorities

Urban rainwater management corresponding to the collection, transport, storage and treatment of rainwater in urban areas constitutes an administrative public service under the responsibility of the municipalities, known as the urban rainwater management public service.

The urban rainwater management service monitors the connection of buildings to the public urban rainwater collection network and compliance with the requirements set in application of the last paragraph of article L. 1331-1 of the public health code and by the zoning defined in 3° and 4° of article L. 2224-10 of this code as well as by the regulations in force. The procedures for carrying out this control are specified by deliberation of the municipal council.

A decree in the Council of State specifies the procedures for applying this article.

Article L2226-1

La gestion des eaux pluviales urbaines correspondant à la collecte, au transport, au stockage et au traitement des eaux pluviales des aires urbaines constitue un service public administratif relevant des communes, dénommé service public de gestion des eaux pluviales urbaines.

Le service de gestion des eaux pluviales urbaines assure le contrôle du raccordement des immeubles au réseau public de collecte des eaux pluviales urbaines et du respect des prescriptions fixées en application du dernier alinéa de l’article L. 1331-1 du code de la santé publique et par le zonage défini aux 3° et 4° de l’article L. 2224-10 du présent code ainsi que par les règlements en vigueur. Les modalités d’exécution de ce contrôle sont précisées par délibération du conseil municipal.

Un décret en Conseil d’Etat précise les modalités d’application du présent article.
