The municipal council deliberates on the management of property and real estate transactions carried out by the municipality, subject, in the case of property belonging to a section of a municipality, to the provisions of articles L. 2411-1 to L. 2411-19.
The balance sheet of acquisitions and disposals carried out on the territory of a municipality with more than 2,000 inhabitants by the municipality itself, or by a public or private entity acting under an agreement with this municipality, is the subject of an annual deliberation by the municipal council. This report is appended to the municipality’s administrative account.
Any sale of buildings or real property rights by a municipality with a population of more than 2,000 requires a reasoned decision by the municipal council on the terms of the sale and its main characteristics. The municipal council deliberates in the light of the opinion of the competent State authority. This opinion is deemed to have been given at the end of a period of one month from the date of referral to this authority.
