Article L225-102-2 of the French Commercial code

For companies operating at least one facility on the list provided for in Article L. 515-36of the Environment Code, the report mentioned in the second paragraph of article L. 225-100 of this code:

-informs the company’s policy for preventing the risk of technological accidents;

-reports on the company’s ability to cover its civil liability with respect to property and individuals arising from the operation of such facilities;

-specifies the resources planned by the company to ensure the management of compensation for victims in the event of a technological accident involving its liability.

Article L225-102-2

Pour les sociétés exploitant au moins une installation figurant sur la liste prévue à l’article L. 515-36 du code de l’environnement, le rapport mentionné au deuxième alinéa de l’article L. 225-100 du présent code :

-informe de la politique de prévention du risque d’accident technologique menée par la société ;

-rend compte de la capacité de la société à couvrir sa responsabilité civile vis-à-vis des biens et des personnes du fait de l’exploitation de telles installations ;

-précise les moyens prévus par la société pour assurer la gestion de l’indemnisation des victimes en cas d’accident technologique engageant sa responsabilité.
