In companies with a Board of Directors or Supervisory Board, the request for an explanation of the worrying nature of the company’s economic situation is placed on the agenda for the next meeting of the Board of Directors or Supervisory Board, provided that the matter has been referred to the Board at least fifteen days in advance. The employer’s reply must state the reasons for the request.
In other legal entities, these provisions apply to the administrative or supervisory body, where such exists.
In other types of companies or in economic interest groupings, where the social and economic committee has decided to inform the partners or members of the company’s situation, the manager or directors shall send them the report of the economic commission or committee.
