Article L2312-69 of the French Labour Code

Every quarter, in undertakings with at least three hundred employees, the employer provides the Social and Economic Committee, under the conditions laid down in the agreement referred to in Article L. 2312-21 or, in the absence of an agreement, in sub-paragraph 4 of paragraph 3 of sub-section 3 of this section, with information on :

1° The general trend in orders and the execution of production programmes;

2° Any delays in the payment of social security contributions by the company;

3° The trend in the number and qualifications of employees by gender.

A Conseil d’Etat decree specifies the content of the information provided for in 3° of this article.

Chaque trimestre, dans les entreprises d’au moins trois cents salariés, l’employeur met à la disposition du comité social et économique, dans les conditions prévues par l’accord mentionné à l’article L. 2312-21 ou à défaut d’accord au sous-paragraphe 4 du paragraphe 3 de la sous-section 3 de la présente section, des informations sur :


1° L’évolution générale des commandes et l’exécution des programmes de production ;


2° Les éventuels retards de paiement de cotisations sociales par l’entreprise ;


3° L’évolution des effectifs et de la qualification des salariés par sexe.


Un décret en Conseil d’Etat précise le contenu des informations prévues au 3° du présent article.
