When justified by the nature and importance of problems common to companies on the same site or in the same area, an inter-company collective agreement concluded between the employers of the companies on the site or in the area and the representative trade union organisations at inter-professional level or at departmental level may set up an inter-company social and economic committee.
The agreement defines:
1° The number of members of the staff delegation of the inter-company social and economic committee;
2° The procedures for their election or appointment;
3° The powers of the inter-company social and economic committee;
4° The operating procedures of the inter-company social and economic committee.
The collective agreement may also decide that in companies with at least eleven employees on the site or in the area that has set up a social and economic committee, a member of the staff delegation from each social and economic committee will attend the monthly meetings.
