Article L2315-13 of the French Labour Code

In temporary employment undertakings, delegation hours used between two assignments, in accordance with contractual provisions, by a full committee member to carry out his mandate, are considered as working hours.

For the purposes of remuneration and social security contributions, these delegation hours are deemed to be attached to the last assignment contract with the temporary employment undertaking for which the full works council member was elected.

Dans les entreprises de travail temporaire, les heures de délégation utilisées entre deux missions, conformément à des dispositions conventionnelles, par un membre titulaire du comité pour l’exercice de son mandat, sont considérées comme des heures de travail.


Ces heures de délégation sont réputées rattachées, en matière de rémunération et de charges sociales, au dernier contrat de mission avec l’entreprise de travail temporaire au titre de laquelle il a été élu membre titulaire du comité.
